Intellectual property in universities can be commercialized by selling, licensing or by the creation of a spin-off company (IPOUK 2011). The Romanian patent jurisprudence (Dominte 2012) show the importance of precisely defining the economic terms related to the gains resulted from the application of the patent in the contract for transferring the rights on patent from its owners to another organization. Even if some of the deliverables will not be accepted as inventions, they still hold the status (by the Romanian legislation, *** 2012) of technological improvements, and thus are subject authorships and rights related to their use, when such a use leads to an increase in the economic performance of the organizations using them.


Universities must seek to preserve as much as possible rights on the background knowledge which allowed the production of process patented items, in order to further develop those research directions by their staff (IPOUK 2011). Publication in research journal of the final results of the research activities should occur only after the patents have been obtained. Contract negotiations should deal only with right leading to commercial benefits. It is also important that client relationships involving the universities are not exclusive, allowing it to work also with other companies in the future. Researcher will keep rights to publish their work separately from ownership/access rights.


The agreement within the consortium for intellectual property protection includes the following: the forms of protection (patent requests to OSIM), the juridical forms for the technological transfer, and clauses (concerning the duties and rights of partners on the inovations resulted from the project, concerning the intelectual rights in a explicit form, concerning the right of the beneficiary in case of technological transfer, and concerning confidentiality). The intellectual property rights for the final deliverable of objective 1 will belong to P1, who will use it for its business development. The intellectual property right on the results from objectives 2 will be pursued in cooperation by CO and P2 to reach transfer into industrial applications. The intellectual property rights on the results from objectives 3 will be pursued in cooperation by CO and P1 to reach transfer into industrial applications.
